Layby Terms & Conditions

These terms are the Layby Purchase Agreement between you and One Stop Deal. Please read them with your plan summary. Your plan summary is the written record we send you. It lists your goods, the total price, your instalments and your payment dates. Together, these terms and your plan summary make up your layby agreement.

We have written these terms in plain English. If anything is unclear, ask us before you agree.

The short version

  • Layby is not credit. You pay for your goods in instalments first. We deliver them once they are paid off.
  • There is no interest, no set-up fee and no late fee. There is no credit check.
  • You can cancel at any time before delivery. If you cancel within 10 business days, you get everything back.
  • After that, a capped cancellation charge applies. We show you the exact amount before you confirm.

While we are taking applications

Right now, the online form on our website is an application. It is not yet a layby agreement.

  • Nothing is charged when you apply. Applying does not reserve or buy anything.
  • We contact you. We will get in touch, usually within one business day, to confirm your plan and to set up your payments securely.
  • When the agreement starts. Your layby agreement is formed when we send you the written layby agreement and you confirm that you accept it. Until then, you can change your mind at no cost, and so can we.
  • Cooling-off. Your cooling-off period of 10 business days runs from the day you confirm the agreement. It does not run from the day you apply.
  • The rest of these terms apply from that confirmation.

Part A: Layby Purchase Agreement

1. Who we are

1.1 We are One Stop Deal. Our online store is called One Stop Deal. In these terms, "we", "us" and "our" mean One Stop Deal. "You" means the person named in the layby agreement.

1.2 You can reach us in these ways:

2. Who can use layby

2.1 You must be 18 or older. We ask for your date of birth to check this.

2.2 You must have a delivery address in New Zealand. We do not deliver overseas.

2.3 The details you give us must be true and your own. You must be allowed to use the bank account or card you pay with.

2.4 There is no credit check. We do not ask for proof of income.

3. How a layby works

3.1 You choose your goods and an instalment that suits you. You pay the instalments over time. When the total price is paid in full, we deliver the goods to you.

3.2 Layby is not a loan and it is not credit. You do not receive the goods until they are paid for. You never owe us interest.

3.3 When the agreement is formed. Your layby agreement is formed when we send you the written layby agreement and you confirm that you accept it. Sending us an application does not form an agreement.

3.4 We may need to check some plans before they start, for example large orders. If so, we will tell you, and we usually finish the check within one business day. If we cannot accept a plan, we refund anything you have paid in full.

3.5 You agree that we can send your layby agreement, receipts and notices to you by email or text message. Please keep your contact details up to date.

4. The price

4.1 The total price is shown in your plan summary. It is in New Zealand dollars and includes GST.

4.2 The price you see is the whole price. There is no interest, no establishment fee and no late fee.

4.3 Once your agreement is formed, the price of your goods is fixed. It will not go up during your plan.

4.4 Delivery is free. The only exception is a delivery surcharge on some oversized items. If a surcharge applies, we show it on the product page and include it in your total before you agree.

4.5 The only other amounts you may ever pay are the cancellation charge in clause 13 and the failed-payment administration fee in clause 8.

5. Your instalments

5.1 You choose how much to pay and how often. You can pay weekly or fortnightly.

5.2 The smallest instalment is $15 a week or $30 a fortnight. Your instalment must also be large enough to pay off your plan within 104 weeks. That is the longest a plan can run.

5.3 The largest instalment you can set online is $500 per payment. You can pay more at any time with an extra payment (clause 7).

5.4 You choose your payday, from Monday to Friday. We collect each instalment on that day.

5.5 Your first payment. If you pay by direct debit, your first payment is on your first payday that is at least 2 business days after your agreement is formed. Card plans can start sooner. We show you the date of your first payment before you agree.

5.6 The number of instalments is the total price divided by your instalment, rounded up. Your last instalment may be smaller, so that you never pay more than the total price.

5.7 We collect each instalment using the payment method in your plan summary. If you pay by direct debit, Part B of these terms also applies. If you pay by bank transfer, you make each payment yourself by the due date, using your plan reference so that we can match it to your plan.

5.8 We send you a receipt for every payment. You can ask us for a statement of your plan at any time.

6. Changing your plan

6.1 You can change your plan at any time. Changes are free. You can:

  • raise or lower your instalment, within the limits in clause 5
  • move your payday to another weekday
  • switch between weekly and fortnightly payments
  • skip a payment.

6.2 A change applies from your next payment that we have not started to process. We need at least 2 business days' notice before that payment is due. If there is less time than that, the change applies from the payment after.

6.3 Skipping a payment. You can skip up to 3 payments on a plan, and no more than one in any 8 weeks. A skipped payment is not cancelled. It moves to the end of your plan, so your plan finishes one payment period later.

6.4 We show you your new schedule and your new finish date before you confirm a change. Nothing changes until you confirm.

6.5 You can make changes in Manage my layby on our website, or by contacting us.

7. Extra payments and paying off early

7.1 You can make an extra payment at any time. The smallest extra payment is $10.

7.2 You can pay off your whole balance at any time.

7.3 There is no penalty and no fee for paying extra or paying early. Paying early means you get your goods sooner.

8. If a payment is missed

8.1 If a payment fails, we tell you by email or text message. We then try to collect it once more, 3 business days later. You can also pay it yourself before then.

8.2 If the second try also fails, we move that instalment to the end of your plan. Your plan runs one payment period longer. We do not charge late fees or penalty interest.

8.3 We charge an administration fee of $2.50 for each payment that is dishonoured (fails). This fee helps cover what a failed payment costs us. It is added to your plan as a separate line. It does not count towards the price of your goods. Your own bank may charge you a fee for a failed payment. That fee is between you and your bank.

8.4 If payments keep failing, we mark your plan as at risk and get in touch to help. Lowering your instalment or moving your payday often fixes the problem. If payments still keep failing, we may suspend your plan. A suspended plan is paused until you contact us and start paying again.

8.5 If we receive no payment on your plan for 8 weeks in a row, you have broken this agreement. We may then cancel your layby under clause 14. We will always try to contact you first.

9. Ownership and risk

9.1 The goods remain ours until the total price is paid in full and the goods are delivered to you.

9.2 The goods are at our risk until they are delivered to you. If they are lost or damaged before delivery, that is our problem to fix, not yours.

9.3 You cannot sell, pledge or transfer goods that have not yet been delivered to you.

10. Delivery

10.1 Delivery is free to addresses anywhere in New Zealand, apart from any oversized-item surcharge shown in your total (clause 4.4).

10.2 We deliver only after your final payment has cleared. Direct debit payments have a clearing hold of 3 business days, because a bank can still reverse a payment during that time. Card payments usually clear straight away.

10.3 Once your final payment has cleared, we dispatch your goods within 5–10 business days. Oversized items are dispatched within 15 business days.

10.4 We send you tracking details when your goods are dispatched. Someone may need to be home to sign for the delivery.

10.5 We deliver to the address in your plan summary. Tell us before your final payment if your address changes. More detail is on our Delivery page.

10.6 We never deliver goods before they are paid for in full. This is what keeps layby simple, and free of interest and credit checks.

11. Plans with more than one item

11.1 You can put more than one item on a plan. You pay one combined instalment.

11.2 Your payments are applied to the cheapest item first, then the next cheapest, and so on. We dispatch each item as it is paid off, under clause 10. Your plan summary shows the order.

11.3 If you would rather have everything delivered together at the end, ask us and we will set your plan up that way.

12. If a product is no longer available

12.1 Sometimes a product is discontinued or we cannot get it. If that happens, we will offer you a substitute that is equal or better, at no extra cost.

12.2 You do not have to accept a substitute. If you say no, we cancel that item and refund everything you have paid towards it, in full. There is no cancellation charge.

13. Your right to cancel

13.1 You can cancel your layby at any time before the goods are delivered to you. You do not have to give a reason.

13.2 Cooling-off period. You have 10 business days from the day your layby agreement is formed. If you cancel in that time, we refund everything you have paid. There is no charge.

13.3 After the cooling-off period. If you cancel later, we keep a cancellation charge and refund the rest. The charge is the greater of $55 or 20% of what you have paid. It is capped at $250. It is never more than you have paid.

13.4 Under the Fair Trading Act 1986, a layby cancellation charge can only reflect our reasonable costs of the layby. These are costs such as administration, storage and any loss in the value of the goods. We have set the charge with that in mind. If you think the charge is more than our reasonable costs, tell us and we will look at it again.

13.5 Before you confirm a cancellation, we show you what you have paid, the charge (if any) and your exact refund. Nothing changes until you confirm.

13.6 To cancel, use Manage my layby on our website or contact us. Your cancellation takes effect on the day you confirm it.

13.7 If some items on your plan have already been delivered, you can cancel only the items that have not been delivered. Payments already applied to delivered items are not refunded under this clause. Your rights under clause 17 still apply to delivered goods.

14. When we can cancel

14.1 We can cancel your layby only if:

  • (a) you have broken this agreement, for example under clause 8.5 or by giving us false details
  • (b) the goods are no longer available because of something outside our control, and you have not accepted a substitute under clause 12
  • (c) we are no longer in business.

14.2 We will tell you in writing if we cancel, and why.

14.3 If we cancel because you have broken this agreement, we refund what you have paid, less the cancellation charge in clause 13.3.

14.4 If we cancel for the reasons in clause 14.1(b) or (c), we refund everything you have paid. There is no charge.

15. Refunds

15.1 We pay refunds back to the payment method you used. Direct debit payments are refunded to the bank account they came from.

15.2 We pay your refund within 5 business days of the cancellation being confirmed. Your bank may take a little longer to show it in your account.

15.3 Any unpaid administration fees under clause 8.3 are taken off your refund. We show you the final refund figure before you confirm a cancellation.

15.4 Small inactive balances. If a cancelled or inactive plan has a balance of under $40 and there have been no payments for six months, we will try to contact you to return it. If we still cannot reach you after two years, we may keep the balance where the law allows.

16. Limits on plans

16.1 You can have up to 3 active plans at one time.

16.2 Across all of your plans, your instalments can add up to no more than $600 per week. A fortnightly instalment counts as half that amount per week.

17. Your consumer rights

17.1 Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

17.2 Under the Consumer Guarantees Act, goods must be of acceptable quality, match their description and be fit for their purpose. If something is wrong with your goods, you may be entitled to a repair, a replacement or a refund. See our Returns & Faulty Goods page.

18. Privacy

18.1 We collect and use your personal information as set out in our Privacy Policy. We follow the Privacy Act 2020.

19. Complaints and disputes

19.1 If something has gone wrong, please contact us first. Most problems can be fixed quickly once we know about them.

19.2 If we cannot sort it out together, you can take a claim to the Disputes Tribunal. It is a low-cost way to settle disputes, and you do not need a lawyer.

19.3 The Commerce Commission publishes information about layby sales and your rights under the Fair Trading Act. You can also report a concern about a business to the Commission.

19.4 If your complaint is about a direct debit, you can also talk to your bank (see Part B).

20. General

20.1 The terms that applied when your layby agreement was formed keep applying to that plan. If we update these terms, the new terms apply to new plans. If a change in the law means we must change a plan that is already running, we will tell you first.

20.2 If a court finds part of these terms cannot be enforced, the rest still applies.

20.3 New Zealand law governs this agreement. The New Zealand courts and the Disputes Tribunal have the power to decide any dispute about it.

Part B: Direct Debit Service Agreement

This part applies only if you pay your instalments by direct debit. It explains how we debit your bank account. It sits alongside the direct debit authority that you sign.

B1. Your authority

B1.1 By signing the direct debit authority, you authorise us to debit your nominated New Zealand bank account for the amounts due under your layby agreement. You also authorise your bank to accept those debits.

B1.2 You confirm that you are allowed to operate the account on your own. If the account needs more than one person to sign, every signatory must sign the authority.

B1.3 We keep a record of your authority. The record includes your signature, the date and time you signed, and the terms you were shown.

B2. What we debit, and when

B2.1 We give you written notice of the amount, the frequency and the date of your first debit before it happens. Your layby agreement and plan summary are that notice. They list every payment date and amount.

B2.2 We only debit amounts that are due under your layby agreement. These are your instalments and any extra payment you ask us to collect. They also include any administration fee under clause 8.3 of Part A.

B2.3 If a due date falls on a day that is not a business day, the debit is processed on the next business day.

B2.4 If you change your plan under clause 6 of Part A, your new schedule is your notice of the new amounts and dates. We send it to you by email or text message before the next debit.

B2.5 If we ever need to change your debit amounts or dates ourselves, we will give you notice in writing beforehand. Changes we start will never make your total price go up.

B3. Your rights

B3.1 You can cancel your direct debit authority at any time. Tell us, or tell your bank. Please tell us as well, so that we can set up another way for you to pay. Cancelling the authority does not cancel your layby on its own. To cancel your layby, see clause 13 of Part A.

B3.2 You can change your instalment, your payday or your payment frequency at any time, under clause 6 of Part A. You can also ask us to debit a different bank account. You will need to sign a new authority for the new account.

B3.3 If you think a debit is wrong, contact us straight away. If we debited you in error, we will put it right. You can also ask your bank to look into the debit or to reverse it. Your bank will tell you how that works and what time limits apply.

B4. If a debit is dishonoured

B4.1 Please make sure there is enough money in your account on each payment date. Your account must be one that accepts direct debits.

B4.2 If a debit is dishonoured (fails), clause 8 of Part A applies. We tell you, and we try once more 3 business days later.

B4.3 We charge an administration fee of $2.50 for each dishonoured debit. Your bank may also charge you its own fee. Your bank's fees are between you and your bank.

B4.4 A bank can tell us that a debit has failed several days after the payment date. That is why we wait 3 business days after your final payment before we dispatch your goods.

B5. How we contact you

B5.1 We send direct debit notices by email or text message, using the contact details on your plan. Please keep them up to date.

B5.2 We keep your bank account details secure and confidential. We use them only to collect your payments and pay your refunds. See our Privacy Policy.
